  1. CYBERVIEW END USER LICENSE AGREEMENT
  2. FOR EVALUATION SOFTWARE PRODUCT
  3. Subjected software product:
  4. CYBERVIEW IMAGE version 4.5.1 EVALUATION
  5.  
  6. This is a legal agreement between you (either an individual or a single 
  7. entity), and CYBERVIEW CORPORATION. ("CYBERVIEW"). located at
  8. 595 Jackson Park Ln. Suwanee, GA 30024 USA.,
  9. regarding use of the CYBERVIEW EVALUATION software product identified
  10. above which may include media, printed materials, electronic documentation
  11. called collectively ("the SOFTWARE"). By installing, copying,
  12. or otherwise using the SOFTWARE, you agree to be bound by the terms
  13. of this Agreement.
  14. If you do not agree to the terms of this Agreement,
  15. do not install or use the SOFTWARE.
  16.  
  17. LICENSE
  18. * CYBERVIEW grants you a limited, non-exclusive, nontransferable, license
  19.   to make and use an unlimited number of copies of the SOFTWARE, solely
  20.   for purposes of testing and evaluation.
  21. * You may not make any changes or modifications to the SOFTWARE or to the
  22.   accompanying materials, and you may not decompile, disassemble, or
  23.   otherwise reverse engineer the SOFTWARE. or create derivative works
  24.   based on the SOFTWARE.
  25. * You may not rent, lease, sublicense the SOFTWARE or
  26.   accompanying materials (if any) to others.
  27. * All other rights are reserved to the CYBERVIEW.
  28.  
  29. DISTRIBUTION
  30. If you publish magazines, news, books, shareware, freeware or demo CD-ROMs
  31. or you are Internet software repository, you are welcome to distribute
  32. the SOFTWARE provided that you will follow the guidelines below:
  33. * You may freely distribute only the MOST RECENT version of the SOFTWARE,
  34.   without any modifications, exactly the same as distributed directly from
  35.   the CYBERVIEW web site: < http://www.cyberviewcd.com >.
  36. * For distributions on CD-ROM disks the MOST RECENT means the CURRENT
  37.   version of the SOFTWARE distributed directly from the CYBERVIEW
  38.   web site at the design time of the media title.
  39. * For electronic/Internet distribution and hosting the SOFTWARE on your
  40.   Internet site, as the MOST RECENT you may consider any one from
  41.   the following:
  42.   a. The latest version of the SOFTWARE about which availability
  43.      you have been notified by the CYBERVIEW.
  44.   b. The CURRENT version of the SOFTWARE distributed directly from 
  45.      CYBERVIEW web site.
  46. * Distribution or association of the SOFTWARE together with pornographic
  47.   materials, other socially offending/sensitive materials,
  48.   other products designed specifically to modify the SOFTWARE or with
  49.   any illegal materials is strictly prohibited.
  50. * You must inform CYBERVIEW about your distribution of the SOFTWARE
  51.   and you must provide the following information:
  52.   a. Your or your organization name and address.
  53.   b. Contact  e-mail address and contact phone number.
  54.   c. Short description of your distribution.
  55.

  62. U.S. GOVERNMENT RESTRICTED RIGHTS 
  63. Use, duplication or disclosure of the SOFTWARE by Government is 
  64. subjected to restrictions set forth in subdivisions (c)(1) (ii) of the 
  65. Rights in Technical Data and Computer Software clause of DFARS 252.227 
  66. 7013 (October 1988) and in subparagraphs (a) through (d) of the 
  67. Commercial Computer-Restricted Rights clause at FAR 52.227-19 (June 
  68. 1987) when applicable.

  71. DISCLAIMER OF WARRANTY
  72. The SOFTWARE is provided "as is" without warranty of any kind, either 
  73. expressed or implied, including but not limited to the implied warranty 
  74. to fitness for any particular purpose. The entire risk as to the 
  75. quality and performance of the SOFTWARE is with you. CYBERVIEW does not 
  76. warrants that the function contained in the SOFTWARE will meet your 
  77. requirements or that the operation of the SOFTWARE will be 
  78. uninterrupted or error free.
  79. CYBERVIEW shall not in any case be liable for special, incidental, 
  80. consequential, indirect or other damages, (including without 
  81. limitation, damages for loss of profits, business interruption, loss of 
  82. information, or other losses) arising out of the use of or inability to 
  83. use this CYBERVIEW product, even if CYBERVIEW or its agent has been 
  84. advised of the possibility of such damages, or for any claim by any 
  85. other party.

  87. EXPORT RESTRICTIONS
  88. The SOFTWARE and underlying information or technology may not be 
  89. downloaded or otherwise exported or re-exported directly or indirectly
  90. into (or to a national or resident of) Cuba, Iraq, Libya, North Korea,
  91. Iran, Syria or any countries that are subject to U.S.A.
  92. export restrictions, or to any end user (person or entity) who has been 
  93. prohibited from participating in the U.S.A. export transactions by any 
  94. federal agency of the U.S.A. government You further acknowledge that 
  95. the SOFTWARE may include technical data subject to export and re-export 
  96. restrictions imposed by U.S.A. law.

  98. TERMINATION
  99. This license will terminate automatically if you fail to comply with the
  100. terms and conditions of this license agreement. On termination, you must
  101. destroy all copies of the SOFTWARE and Documentation.
  102.  
  103. TITLE and COPYRIGHT
  104. Title, ownership rights, and intellectual property rights in the 
  105. SOFTWARE remains in CYBERVIEW and/or its suppliers.
  106. The SOFTWARE is protected by the United States copyright laws
  107. and international treaty provisions.
  108.  
  109. GENERAL
  110. Any rights not specifically granted in this statement are reserved by 
  111. CYBERVIEW.
  112. This agreement will be governed by the lows of current home state of 
  113. CYBERVIEW which currently is the State of Georgia, USA This is a legal 
  114. document which constitutes the entire agreement between the parties: 
  115. CYBERVIEW  and you the enduser (either the individual or entity) and 
  116. supersedes any prior agreement oral or written, relating to the subject 
  117. of this LICENSE AGREEMENT. This Agreement may only be modified by a 
  118. written agreement signed by authorized officer of CYBERVIEW.

  120. YOU ACKNOWLEDGE THAT YOU HAVE READ THIS AGREEMENT,
  121. UNDERSTAND IT, AND AGREE TO BE BOUND BY ITS TERMS
